These terms and conditions of use (“Terms of Use”) govern your use of our online interfaces and properties (e.g., websites and mobile applications) owned and controlled by CareConnect Health, Inc. (“CareConnect Health”) and the services available to users through the Site (“Services”). Your compliance with these Terms of Use is a condition to your use of the Site. If you do not agree to be bound by the Terms of Use, promptly exit this Site. Please also consult our Privacy Policy for a description of our privacy practices and policies, including how we collect and handle your personal health information and financial information.

Privacy Policy

Your privacy is of the utmost importance. Any use or disclosure of your health information through this website is described under our Notice of Privacy Practices available at instavisit.ricks75.sg-host.com.

The following Privacy Policy applies to information other than your health information that is collected in the course of your use of CareConnect Health Web Site, as well as any related mobile applications or services.

CareConnect Health uses the personal information we collect from you to enable the features you are using and provide the services that you request. We might also use the information to request your feedback; to improve the service; to provide you with advance notice of events; or to tell you about new or additional service offerings. Except as described in this Privacy Policy or as specifically requested by you, CareConnect Health will not disclose, rent, or sell any personal information it gathers from you to any third parties outside of its affiliates and contractors.

Personal information you choose to provide to CareConnect Health

In the course of using CareConnect Health Web Site and related mobile applications or  services, there are times when you may choose to share your personal information.

Sign-Up Information. You provide us with personal information, such as your name and email address when you request services from CareConnect Health.

Contacting us. If you email us through contact us page on this website, we may ask you for information such as your name and email address so we can respond to your questions and comments. If you choose to correspond with us via email, we may retain the content of your email messages, your email address and our response to you. In certain cases, and only with your express permission, we may post content from your emails to our websites.

Surveys and market research. CareConnect Health is committed to constantly improving our services. To support this commitment we may occasionally ask users of our site to complete online surveys, or to participate in online or in-person feedback meetings. If you choose to participate in one of these activities we may ask you to enter personal information. The information you submit may be used to measure of the effectiveness of our website, services and content.

Information about your use of the CareConnect Health website and applications

When you visit our website or use a mobile application, we may collect information regarding your visit from your computer or mobile device. Such information helps us to determine information about how you found our site, the date that you visited, and what search engine may have led you to our website. We collect this information in order to continually improve and enhance CareConnect Health’s services.

Log Data. When you use the CareConnect Health website or an application, our systems may automatically record information from your computer or device, its software, and your activity on our site. This may include the Internet Protocol (“IP”) address, browser type, the web page visited before you came to our website, information you search for on our website, identification numbers associated with your devices, your ISP or mobile carrier, date and time stamps associated with transactions, system configuration information, and other interactions with our service.

Cookies. We may use “cookies” on or in connection with our website to collect and maintain information about you. A cookie is a very small text document, which often includes an anonymous unique identifier. We may use cookies to make the website more convenient, to better understand how you interact with our site, and to monitor aggregate usage and web traffic routing. We use this information to monitor and analyze use of our website, for technical administration of the site, and to improve our services and content. As of the date this policy went into effect, we use Google Analytics.

Sharing Information With Third Parties

Service providers. We may use certain trusted third party companies and individuals to help us provide, analyze, and improve our services (including but not limited to maintenance services, database management, web analytics and payment processing). These third parties may have access to your information only for purposes of performing these tasks on our behalf and are under obligations similar to those in this Privacy Policy.

Aggregate statistics. We may disclose non-personally identifiable aggregate statistics regarding user behavior to third parties in the form of aggregate data or reports, which do not describe or identify any individual user. Information relating to aggregate statistics may be collected through the use of third-party cookies and other third-party tracking devices.

Legally compelled disclosure. We may disclose your personal information if required to do so by law or subpoena, or if we believe that such action is necessary to (a) conform to the law, comply with a judicial or court order or comply with legal process served on us or Affiliated Parties; (b) protect and defend our rights and property, the website, the users of the website, and/or our Affiliated Parties; or (c) act under circumstances to protect the safety of users of our website, us, or third parties.

Third-party websites

When you are on the CareConnect Health website you may have the opportunity to visit or link to other websites, including websites operated by unaffiliated third parties. These websites may collect personal information about you, and because this Policy does not address the information practices of those other websites, you should review the privacy policies of such other websites to see how they treat your personal information.

Privacy of minors

The parent or legal guardian must request care for persons under the age of eighteen. As with any patient, their health information is protected by the Notice of Privacy Practices that is disclosed at the time the patient consents to treatment.

Security

CareConnect Health takes information security seriously. We use commercially reasonable, industry-standard technical, physical and operational safeguards to preserve the security of your personal information, both when it is transmitted to us and when we receive it. When you enter sensitive information (such as a credit card number) on our website, we encrypt the transmission of that information using Secure Socket Layer (SSL) technology. Video streams used for patient webcam visits are encrypted and are not recorded or stored. No method of electronic transmission or storage is 100% secure, however. Therefore, we cannot guarantee absolute security of your Personal Information.

Password Security

You are solely responsible for the security of your username and password, and for any use of the Services using your username and password.  You should not share your username or password with any third party or allow any third party to access the Services using your username and password.  You agree to notify us if you have any reason to believe that your username or password has been lost, compromised, or misused in any way.  We reserve the right to revoke or deactivate your username and password at any time.

Description of CareConnect Virtual Care (CareConnect InstaVisit and Chronic Care 360)

CareConnect Virtual Care (CareConnect InstaVisit and Chronic Care 360) are programs offered and operated by CareConnect Health. CareConnect Virtual Care arranges for health care services by licensed and board-certified medical providers (“Providers”) in the state of Georgia, who are employees or contractors of CareConnect Health. CareConnect Virtual Care provides access to various online services that enable users to receive telehealth services (“Virtual Visits and Remote Patient Monitoring”) from health care providers located in the state of Georgia, USA. CareConnect Health, Inc. has contracted with VSee Lab, Inc. (“Vsee Lab”), a California corporation, for necessary technology services and intellectual property to offer these services, and Virtual Care is delivered exclusively by CareConnect Health, a Georgia professional services corporation.

Vsee Lab is not a healthcare provider and takes no part in your health care diagnosis or treatment

Vsee Lab does not furnish healthcare services directly to users. Vsee Lab operates the Vsee Clinic which facilitates access to healthcare services delivered by Georgia – licensed healthcare providers through CareConnect Virtual Care.

Do not use CareConnect Virtual Care for emergency medical needs

CareConnect Virtual Care is not appropriate to address emergency or life-threatening medical conditions, and should not be used in such circumstances. If you believe your situation involves a medical emergency, immediately call 911 or go to a hospital emergency room. CareConnect Virtual Care services providers may direct website users to an emergency room or other appropriate facility at any time.

Virtual Care eligibility requirements

To use the CareConnect Virtual Care and its services, you must meet the following requirements:

You are 18 years of age or older. A parent or legal guardian may request a referral for services on behalf of minor children and/or dependents. However, CareConnect Virtual Care will not arrange services for any minor, even if such minor is legally authorized to consent to such treatment, without the minor’s parent or legal guardian participating in the consultation.

You are currently located in the state of Georgia, USA. CareConnect Virtual Care services are provided only to individuals in the state of Georgia, USA. You hereby certify that you are physically located in the State you have entered as your current location on the Services.  You acknowledge that your ability to access and use the Services is conditioned upon the truthfulness of this certification and that the Providers you access through the Services are relying upon this certification in order to interact with you.  In the event that your certification is inaccurate, you agree to indemnify CareConnect Health and the Providers you interact with from any resulting damages, costs, or claims.

Applies to CareConnect InstaVisit Only:

To use CareConnect InstaVisit and receive a Virtual Visit, you must meet the following requirements:

You are not a federal healthcare program (i.e., Medicare, Medicaid) beneficiary. If you provide false or deceptive information regarding your federal healthcare program enrollment status, CareConnect InstaVisit reserves the right to refuse all current or future use of CareConnect InstaVisit services.

Consent for Treatment Performed

Telemedicine involves the use of communications to enable healthcare providers at sites remote from patients to provide consultative services.  Providers may include primary care providers, behavioral health providers and other primary healthcare related providers (e.g. dieticians).  The information may be used for diagnosis, treatment, therapy, counselling, follow-up and/or education, and may include live two-way audio and video and other materials (e.g., medical records, data from medical devices).

The communications systems used will incorporate reasonable security protocols to protect the confidentiality of patient information and will include reasonable measures to safeguard the data and to ensure its integrity against intentional or unintentional corruption.  At the end of each visit, the patient will be provided a visit summary, which may be kept for the patient’s records and may be shared with the patient’s local primary care or other provider, as appropriate.

Anticipated Benefits of Telemedicine:

  • Improved access to medical care by enabling a patient to remain at his or her home or office while consulting a clinician.
  • More efficient medical evaluation and management.

Possible Risks of Telemedicine:

As with any medical procedure, there are potential risks associated with the use of telemedicine.  Provider believes that the likelihood of these risks materializing is very low.  These risks may include, without limitation, the following:

  • Delays in medical evaluation and consultation or treatment may occur due to deficiencies or failures of the equipment.
  • Security protocols could fail, causing a breach of privacy of personal medical information.
  • Lack of access to complete medical records may result in adverse drug interactions or allergic reactions or other negative outcomes.

By accepting these Terms, you acknowledge that you understand and agree with the following:

  1. I understand that the laws that protect privacy and the confidentiality of medical/behavioral health information also apply to telemedicine; I have reviewed the Privacy Policy which explains these issues in greater detail.
  2. I understand that telemedicine may involve electronic communication of my personal medical/behavioral health information to medical practitioners who may be located anywhere in the state of Georgia, USA.
  3. I understand that I may expect the anticipated benefits from the use of telemedicine in my care, but that no results can be guaranteed or assured.
  4. I understand that my healthcare information may be shared with others (including health care providers and health insurers) for treatment, payment, and healthcare operations purposes. Psychotherapy notes are maintained by clinicians but are not shared with others, while billing codes and visit summaries are shared with others and with me.  If I obtain psychotherapy from Provider, I understand that my therapist has the right to limit the information provided to me if in my therapist’s professional judgment sharing the information with me would be harmful to me.
  5. I further understand that my healthcare information may be shared in the following circumstances:
    1. When a valid court order is issued for medical records.
    2. Reporting suspected abuse, neglect, or domestic violence.
    3. Preventing or reducing a serious threat to anyone’s health or safety.

Patient Consent to the Use of Telemedicine

I have read and understand the information provided above, and understand the risks and benefits of telemedicine, and by accepting these Terms I hereby give my informed consent to participate in a telemedicine visit under the terms described herein.

Changes

These Privacy Practices may change from time to time. In the event there are changes in the way we treat your personal information, we will display a notice on the CareConnect Health website and/or send you an email so that you may review the changed terms prior to continuing to use the site. By continuing to use the Service after those changes become effective, you agree to be bound by the revised Privacy Practices.

Payment Authorization

You agree that you are financially responsible for any fees incurred from receiving Virtual Care or other health care services received from CareConnect Health.

By providing a credit card or other payment method accepted by CareConnect Health (“Payment Method”), you are expressly agreeing that we are authorized to charge to the Payment Method any fees for your use of the Services, together with any applicable taxes.  Please note that CareConnect Health may not receive complete information from your health insurance plan, if applicable, regarding the applicable co-pay due from you for your consultation.  As such, you may be billed more than once with respect to a consultation to account for additional co-pay amounts due, if any.

You agree that authorizations to charge your Payment Method remain in effect until you cancel it in writing, and you agree to notify CareConnect Health of any changes to your Payment Method.  You certify that you are an authorized user of the Payment Method and will not dispute charges for the Services that correspond to consultation fees or the co-payment required by your health plan.  You acknowledge that the origination of ACH transactions to your account must comply with applicable provisions of U.S. law.  In the case of an ACH transaction rejected for insufficient funds, CareConnect Health may at its discretion attempt to process the charge again at any time within 30 days.

You acknowledge and agree that fees for consultations may increase at any time.

Notices

You agree that we may send to you in electronic form any privacy or other notices, disclosures, reports, documents, communications or other records regarding the services (collectively, “Notices”). We can send you electronic Notices: (1) to the e-mail address that you provided to us during registration, or (2) by posting the Notice on the applicable service or otherwise through the website. The delivery of any Notice from us is effective when sent by us, regardless of whether you read the Notice.

Indemnification

You understand and agree that you are personally responsible for your behavior on the website. You agree to indemnify, defend and hold harmless CareConnect Health, its subsidiaries, affiliated companies, joint ventures, business partners, sub-contractors, providers, licensors, employees, agents, Vsee Lab, and any third-party information providers from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorneys’ fees, resulting from or arising out of your use of, or inability to use, the website, your use of CareConnect Health services, or any violation by you of this Agreement.

All of the content featured or displayed on the website, is owned by CareConnect Health, its licensors, vendors, agents and/or content providers. All elements of the website, including without limitation the general design and the content, are protected by trade dress, copyright, moral rights, trademark and other laws relating to intellectual property rights. The services and the website may only be used for the intended purpose for which the website and services are being made available. Except as permitted by copyright law, you may not modify any of the materials nor may you copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information or work contained on the website. You will not remove any copyright, trademark or other proprietary notices from material found on this website.

We attempt to ensure that information on the website is complete, accurate and current. Despite our efforts, the information on the website may occasionally be inaccurate, incomplete or out of date. We make no representation as to the completeness, accuracy or currency of any information on the website. From time to time, the website may contain links to web sites that are not owned, operated or controlled by CareConnect Health, Vsee Lab or its affiliates. All such links are provided solely as a convenience to you. Neither we nor any of our respective affiliates endorse, guarantee, or make any representations or warranties regarding any other web sites, or any content, materials or other information located or accessible from any other web sites, or the results that you may obtain from using any other web sites.

You agree that you will not: (i) take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper working of the site or any activities conducted on the website; or (iii) bypass any measures we may use to prevent or restrict access to the website.

Any of the terms of this Agreement that are determined to be invalid or unenforceable shall be ineffective to the extent of such invalidity or unenforceability, without rendering invalid or unenforceable any of the remaining terms of this Agreement or affecting the validity or enforceability of the Agreement as a whole. Failure to insist on performance of any of the terms of the Agreement will not operate as a waiver of any subsequent default. No waiver by CareConnect Health of any right under this Agreement will be deemed to be either a waiver of any other right or provision or a waiver of that same right or provision at any other time. You agree that these Terms of Use and all incorporated agreements may be assigned by CareConnect Health to a third party as determined by us in our sole discretion.

This Agreement shall be binding upon and inure to the benefit of each of the parties and the parties’ respective successors and permitted assigns. CareConnect Health is designed and made available to residents of the United States only. By visiting the website or accessing CareConnect Health services, you agree that the laws of the State of Georgia, without regard to principles or conflict of laws, will govern this Agreement and any dispute that might arise between you and CareConnect Health. Any dispute relating in any way to your visit to the website or CareConnect Health services made available through the website will be adjudicated in state or federal court in the State of Georgia and you consent to exclusive jurisdiction and venue in such courts.
